DMCA Policy

How to File a DMCA Takedown Notice

If you believe your copyrighted work has been copied and posted on pixelcleardesigns.com in a way that constitutes copyright infringement, you may submit a takedown notice. • Identification of the material claimed to be infringing or to be the subject of infringing activity and that is to be removed or access disabled, along with information reasonably sufficient to permit us to locate the material (e.g., specific URL(s)).
  • Your contact information: full name, postal address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification Process

If you believe material you posted on pixelcleardesigns.com was removed or disabled by mistake or misidentification, you may submit a counter-notification. This allows you to dispute the copyright infringement claim. Your counter-notice must be in writing and sent to our DMCA Agent.

Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or to which access was disabled, and the location on pixelcleardesigns.com where the material appeared before it was removed or disabled (e.g., specific URL(s)).
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which pixelcleardesigns.com may be found. You must also agree to accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against you, we may restore the removed content within 10 to 14 business days.

Repeat Infringer Policy

PixelClear Designs maintains a strict policy regarding repeat infringers. We will terminate the accounts of users who are determined to be repeat copyright infringers. This action includes the removal of all content published by such users on our platform.

We are committed to upholding intellectual property rights and ensuring our platform respects original creative work, whether it details “The Physics of Silence” or “Luxury Versace Furniture.” This policy helps us maintain a platform that values original contributions.
